BakersPro (“BakersPro,” “we,” “our,” or “us”) is a business management app designed to help bakers manage pricing, customer requests, quotes, invoices, payments, customer records, recipes, ingredients, orders, and related workflow activities.
By creating an account, accessing, downloading, subscribing to, or using BakersPro, you agree to these Terms of Service (“Terms”). If you do not agree to these Terms, do not use BakersPro.
These Terms apply to the BakersPro mobile application, website, related pages, support channels, subscriptions, features, tools, and services (collectively, the “Service”).
1. Eligibility and Use of the Service
You may use BakersPro only for lawful business, professional, or personal commercial workflow purposes related to baking, cake decorating, food service, and related business activities.
You must be legally able to enter into a binding agreement in your location. BakersPro is intended for adults and business users. It is not intended for use by children.
You are responsible for ensuring that your use of BakersPro complies with all laws, rules, and regulations that apply to you in your country, province, state, city, or other local area.
2. Account Responsibility
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
You agree to provide accurate account information and to keep your information up to date.
You must not share your account, login credentials, or access to BakersPro with unauthorized users.
You are responsible for securing your own devices, passwords, internet connection, and business records.
3. Subscriptions, Trials, Billing, and Renewals
Some BakersPro features may require a paid subscription or in-app purchase. Pricing, billing terms, trial periods, renewal terms, subscription benefits, and cancellation options are presented in the app, checkout flow, app store listing, or applicable payment platform at the time of purchase.
Subscriptions may renew automatically unless cancelled before the renewal date, depending on the billing platform used.
If you purchase through Apple App Store or Google Play, your purchase, renewal, cancellation, refund request, and billing management are handled by Apple or Google under their applicable terms and policies. BakersPro does not control Apple or Google billing decisions.
If you purchase through Stripe or another approved payment provider, your billing and payment terms may be managed by that provider and/or by BakersPro, depending on the purchase flow.
Deleting your BakersPro account or uninstalling the app does not automatically cancel an active subscription. You are responsible for cancelling your subscription through the applicable app store, payment provider, or billing platform.
Except where required by applicable law or expressly stated in the applicable purchase terms, subscription payments are non-refundable once billed.
4. App Store and Third-Party Billing Terms
BakersPro may be made available through third-party app stores or platforms, including Apple App Store and Google Play.
When you download, purchase, subscribe, or manage billing through a third-party platform, that platform’s terms, conditions, billing rules, refund rules, and privacy practices may also apply.
If there is a conflict between these Terms and the mandatory terms of Apple, Google, or another app store provider for app-store purchases, the applicable app-store terms may control for that purchase to the extent required by that platform or applicable law.
5. User Content and Business Data
You retain responsibility for the data you enter into BakersPro, including business details, pricing information, recipes, ingredients, customer details, order records, invoices, quotes, delivery details, uploaded files, images, and payment-related records (“User Content”).
You represent that you have the right to upload, store, process, and use any User Content you submit to BakersPro.
You remain responsible for the accuracy, legality, reliability, and appropriateness of your User Content.
BakersPro is not responsible for correcting inaccurate information you enter, including customer details, recipe inputs, pricing data, labour rates, overhead settings, tax settings, delivery details, invoice details, or order terms.
6. Customer Data Entered by Users
If you enter your own customers’ personal information into BakersPro, including names, phone numbers, email addresses, delivery addresses, order notes, invoice details, or payment-related records, you are responsible for ensuring that you have the right to collect, use, store, and manage that information in BakersPro.
You are responsible for complying with any privacy, consent, recordkeeping, and customer-notice obligations that apply to your own baking business or location.
BakersPro does not independently control your relationship with your customers and is not responsible for disputes between you and your customers.
7. Pricing, Profit, Tax, and Business Calculations
BakersPro may provide tools to help estimate pricing, recipe costs, labour, overhead, profit margins, invoices, deposits, balances, and related business figures.
These tools are provided for convenience and workflow support only. BakersPro does not guarantee that any calculation, price, invoice, quote, profit estimate, tax amount, or business recommendation is accurate, complete, compliant, profitable, or appropriate for your specific business.
You are responsible for reviewing all figures before using them with customers or in your business.
BakersPro is not financial, accounting, tax, legal, business, or professional advice. You should consult qualified professionals where needed.
8. Payments, Deposits, Invoices, and Customer Transactions
BakersPro may support payment-related workflows, invoice records, deposit tracking, payment status updates, or integrations with third-party payment providers.
BakersPro is not a bank, payment processor, escrow service, marketplace, money transmitter, or financial institution.
Payments between bakers and their customers are the responsibility of the baker, the customer, and any third-party payment processor used.
BakersPro is not responsible for disputes between bakers and their customers regarding products, order fulfillment, deposits, refunds, cancellations, delivery, quality, chargebacks, missed payments, final payments, or other transaction issues, except where required by law.
You are responsible for ensuring that your invoices, payment requests, deposits, refund terms, cancellation policies, tax settings, and customer communications comply with applicable laws.
9. Food Safety, Allergens, Licensing, and Local Business Compliance
You are solely responsible for complying with all laws, regulations, permits, licenses, inspections, food-safety rules, allergen requirements, labelling rules, tax requirements, home-business rules, and consumer-protection obligations that apply to your baking business.
BakersPro does not verify whether your business is licensed, compliant, insured, or legally permitted to sell food products in your location.
BakersPro is not responsible for food-safety issues, allergic reactions, illness, injuries, product defects, customer complaints, regulatory penalties, or legal claims arising from your products, services, or business operations.
10. Acceptable Use
You agree not to:
use BakersPro for unlawful, fraudulent, misleading, abusive, or harmful purposes
interfere with, disrupt, reverse engineer, copy, scrape, or attack the Service
attempt unauthorized access to BakersPro systems, data, accounts, or infrastructure
upload unlawful, harmful, infringing, defamatory, discriminatory, obscene, abusive, or malicious content
upload malware, viruses, spyware, or harmful code
use BakersPro to violate privacy, consumer-protection, tax, payment, food-safety, intellectual-property, anti-spam, or other applicable laws
misuse subscriptions, trials, payment systems, discounts, refunds, or promotional offers
use the Service in a way that harms BakersPro, other users, service providers, or third parties
We may investigate suspected misuse and may suspend or terminate access where appropriate.
11. Intellectual Property
BakersPro, including its software, design, branding, logos, interface, features, workflows, text, graphics, templates, and related content, is owned by BakersPro and/or its licensors and is protected by intellectual-property laws.
Subject to your compliance with these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to use BakersPro for your own lawful business or personal commercial workflow purposes.
You may not copy, modify, resell, rent, lease, distribute, create derivative works from, reverse engineer, or exploit BakersPro except as expressly permitted by law or by written permission from us.
12. Privacy
Your use of BakersPro is also governed by our Privacy Policy.
The Privacy Policy explains how we collect, use, disclose, retain, and protect personal information, including account information, app data, customer data entered by users, subscription information, technical data, and communication preferences.
By using BakersPro, you agree to the practices described in the Privacy Policy.
13. Service Availability, Updates, and Changes
We may update, modify, suspend, remove, replace, or discontinue parts of BakersPro at any time.
We may release updates, bug fixes, improvements, new features, pricing changes, subscription changes, or feature changes.
We do not guarantee that BakersPro will always be available, uninterrupted, secure, error-free, compatible with every device, or free from data loss or technical issues.
Some features may depend on third-party services, internet access, app-store availability, payment providers, or device compatibility.
14. Data Backup and Export Responsibility
BakersPro may store business data you enter into the app, but you remain responsible for maintaining your own backup copies of important business records, invoices, customer details, recipe information, pricing records, and other data.
We are not responsible for loss of data, inability to access data, accidental deletion, device issues, account access problems, third-party outages, or failure to maintain your own records, except where liability cannot be excluded by law.
15. Account Deletion and Data Deletion
You may stop using BakersPro at any time.
You may request deletion of your account through the in-app Delete Account process or by following our deletion instructions.
Deleting your account may permanently remove access to your saved business data, recipes, ingredients, customers, orders, invoices, uploaded files, subscription-related app access, and other information associated with your account.
Deleting your account does not automatically cancel subscriptions managed by Apple, Google, Stripe, or another payment provider. You must cancel any active subscription through the applicable app store, payment provider, or billing platform.
We may retain certain information where required or permitted for legal, tax, billing, fraud-prevention, security, dispute-resolution, backup, audit, or recordkeeping purposes.
16. Termination and Suspension
We may suspend, restrict, or terminate your access to BakersPro if:
you violate these Terms
you misuse the Service
your payment fails or subscription expires
you create legal, security, fraud, technical, or business risk
we are required to do so by law, app-store rule, payment provider, court order, or regulatory authority
the Service or part of the Service is discontinued
Upon termination, your right to use BakersPro ends immediately.
Sections intended to survive termination will continue to apply, including provisions relating to user responsibility, payment obligations, intellectual property, disclaimers, limitation of liability, indemnity, governing law, and dispute resolution.
17. Disclaimers
BakersPro is provided on an “as is” and “as available” basis.
To the maximum extent permitted by law, we disclaim all warranties, conditions, guarantees, and representations, whether express, implied, statutory, or otherwise, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, availability, compatibility, uninterrupted service, and error-free operation.
We do not guarantee that BakersPro will meet your expectations, improve your business, increase profit, prevent losses, prevent missed orders, prevent customer disputes, produce accurate pricing, or ensure legal compliance.
Some jurisdictions do not allow certain exclusions or limitations, so some of the above may not apply to you.
18. Limitation of Liability
To the maximum extent permitted by law, BakersPro and its owners, operators, directors, officers, employees, contractors, affiliates, service providers, and licensors will not be liable for indirect, incidental, consequential, special, exemplary, punitive, or business damages, including lost profits, lost revenue, lost customers, loss of goodwill, loss of data, business interruption, customer disputes, missed orders, failed payments, pricing errors, tax errors, invoice errors, chargebacks, or regulatory issues arising from or related to your use of the Service.
To the maximum extent permitted by law, our total liability for any claim relating to BakersPro will not exceed the amount you paid for BakersPro during the three months before the event giving rise to the claim, or CAD $100, whichever is greater.
Nothing in these Terms limits liability that cannot be limited under applicable law.
19. Indemnity
You agree to defend, indemnify, and hold harmless BakersPro and its owners, operators, directors, officers, employees, contractors, affiliates, service providers, and licensors from and against any claims, damages, losses, liabilities, costs, and expenses, including reasonable legal fees, arising from or related to:
your use or misuse of BakersPro
your violation of these Terms
your User Content
your business operations
your products, services, orders, invoices, deposits, payments, refunds, deliveries, or customer disputes
your violation of laws or third-party rights
your handling of customer personal information
your food-safety, allergen, licensing, tax, or regulatory obligations
20. Third-Party Services
BakersPro may use or integrate with third-party services for authentication, hosting, database storage, payments, subscriptions, analytics, diagnostics, notifications, email, support, infrastructure, or other functions.
These may include services such as Supabase, RevenueCat, Apple, Google, Stripe, analytics providers, notification providers, email providers, and other service providers.
Third-party services are governed by their own terms and privacy policies. We are not responsible for third-party outages, errors, billing decisions, processing delays, rejected payments, app-store decisions, subscription rules, privacy practices, or service interruptions.
21. International Use
BakersPro may be available in multiple countries. We make no representation that BakersPro is appropriate, lawful, or available for use in every country or location.
You are responsible for complying with the laws that apply to you in your location.
If you use BakersPro outside Canada, you do so on your own initiative and are responsible for compliance with applicable local laws.
22. Consumer Rights and Local Law
Nothing in these Terms is intended to limit, exclude, or restrict any non-waivable consumer rights that apply to you under applicable law.
If any provision of these Terms is found to be unenforceable in your location, that provision will apply only to the maximum extent permitted, and the remaining provisions will remain in effect.
For users in jurisdictions with mandatory consumer-protection rules, those mandatory rules may apply despite anything inconsistent in these Terms.
23. Governing Law and Dispute Resolution
These Terms are governed by the laws of Alberta, Canada and applicable Canadian federal laws, without regard to conflict-of-law principles.
Subject to any mandatory consumer-protection rights that apply in your location, you agree that disputes relating to these Terms or BakersPro will be resolved in the courts located in Alberta, Canada.
Nothing in this section prevents either party from seeking urgent injunctive or equitable relief where appropriate.
24. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we may provide notice where appropriate, such as through the app, website, email, or updated effective date.
Your continued use of BakersPro after the updated Terms take effect means you accept the revised Terms, to the extent permitted by law.
If you do not agree to the updated Terms, you must stop using BakersPro.
